This Privacy Policy governs the manner in which RUIDO COMPANY LLC  (“Ruido Fest”) collects, uses, maintains and discloses information collected from users (each, a “User” or “you”) of the https://ruidofest.com website and other Sites owned by Ruido Fest, (each, a “Site”) and any other means by which we may collect information about you, including information you may provide to us other than on the Site. This privacy policy applies to the Site and all products (“Products”) and services (“Services”) offered by Ruido Fest. This policy also applies to data Ruido Fest may collect across unaffiliated sites to help us provide our Products and Services, better understand our Users, and improve the Products and Services and deliver the best User experience through the Site.

We encourage you to carefully read this Privacy Policy. Ruido Fest is committed to protecting the privacy of its Users and this Privacy Policy is designed to help you understand what information we collect, how we use it, and what we do to protect it so that you can make informed decisions when interacting with the Site or using the Services.

Consent

By accessing our Site, purchasing our Products, and using our Services, you accept and agree to this Privacy Policy and you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. Each time you visit our Site, purchase a Product or Service, and any time you voluntarily provide us with information, you agree that you are consenting to our collection, use and disclosure of the information that you provide, and you are consenting to receive emails, SMS text messages, other targeted communications, or otherwise be contacted, as described in this Privacy Policy. Whether or not you register or create any kind of account with us, this Privacy Policy applies to all users of the Site and purchasers of Products and Services. In the event of a change to this Privacy Policy, we will update the “Last Modified” date above and notify you on our homepage that the Privacy Policy has been recently updated. Your continued use of the Site or completion of a purchase after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. If you do not agree with our policies and practices, do not use or access the Site or make any purchases through the Site or any third-party integrated site, platform or app (“Affiliated Site”).

Information We Collect

We may collect two categories of information from you, Personal Information and Non-Personal Information, each of which is described below.

Personal identification information

We may collect Personal Information from Users through the Site and Affiliated Sites. “Personal Information” includes information that can be used to personally identify you, such as name, email address, mailing address, phone number and billing information, username and password. We may collect Personal Information in a variety of ways, including, but not limited to, when Users visit our Site, register on the Site, place an order on the Site for Products or Services or otherwise with Ruido Fest, subscribe to the newsletter, opt-in to SMS text messaging, and in connection with other activities, services, features or resources we make available on our Site or through the Services. Users may be asked for, as appropriate, name, email address, mailing address, phone number, and credit card information. While we may collect Personal Information from you, we may also authorize our Integrated Sites to collect Personal Information from you with your consent. For example, if you make a purchase through a third-party ticketing platform to one of our events, you may be asked for payment information as part of the transaction. That information may or may not be shared and/or stored by us. You are encouraged to review the privacy practices of any Integrated Site.

Users may, however, visit our Site without submitting any Personal Information. We will collect personal identification information from Users only if they voluntarily submit such information to us. Personal Information that we collect depends on how you use the Site. For example, by registering for an account, we may collect certain information to enable the account setup, such as username, name, email address and other clearly stated items during the account setup process. If you place an order through our Site, we may collect additional information like shipping and billing address and financial information like credit card number, expiration date, security code and other billing information to permit us to process payments for items you purchase through the Site. Providing your Personal Information to us is your choice. If you choose not to provide us with certain Personal Information, you may not be able to take advantage of certain features of the Site, may not be able to create an account, and may not be able to make purchases from the Site.

If you purchase tickets to an event or other Products through our Site your payment will be processed through an Integrated Site. We may utilize eTix, AXS, ticketweb.com and Eventbrite.com, and other online and offline platforms to process ticking transactions. We use Stripe to process Product sales from our Site. You understand and agree that those Integrated Sites have their own privacy policies and that any Personal Information provided to purchase event tickets Products, or other Services are subject to the applicable Integrated Site privacy policy and other terms of use. Users may be able to purchase certain recurring subscriptions through the Site (“Subscriptions”). By purchasing a subscription through the Site, you agree that Ruido Fest may acquire your Personal Information on a recurring basis until your Subscription is cancelled.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site, an Integrated Site, purchase a Product or Service, or otherwise engage with Ruido Fest or the Site. Non-personal identification information includes information that cannot be used by us to personally identify you, even if it may specifically be about you, such as anonymous usage data, general demographic information, ISP utilized to access our Site, referring/exit pages and URLs, platform types, preferences you may submit to us and preferences that are generated based on the data you submit, number of clicks, and similar technical information, your social and purchase habits (for example how frequently you attend live events or interact with Ruido Fest or Ruido Fest acts). We automatically receive information about your interactions with our Site, such as the pages or other content you view, the products you search for or purchase, and the dates and times of your visits, to help us understand how you use our Sites and App, help us improve our Sites and App, and provide you information about our Sites. We also use this information for analytics purposes. This Privacy Policy does not limit in any way our use, sharing, or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers, Integrated Sites, Third Party Sites (for example, sites providing automated marketing or website visitor analytics) and other third parties in our sole discretion.

Web Browser Cookies

As with many other websites, the web servers used to operate the Site may automatically collect certain data pertaining to you, including your location, computer operating system, Internet Protocol (IP) address, access times, browser type and language, and the website you visited before or after visiting our Site. For security reasons and to confirm the integrity of the Site, Ruido Fest, our Integrated Sites, third-party service providers, including third-party vendors, consultants, sales and ordering platforms, data warehouses and other service providers who work for us (our “Contractors”) may combine components of these data with personal information, which may identify you. Unless otherwise described in this Privacy Policy, such identifying information will be used solely for our business purposes. Ruido Fest and our Contractors may use this information to help administer the Site and the servers that provide the Site, generate statistical information, monitor and analyze traffic and usage patterns on the Site and improve the Site’s content and content delivery, including any online content, materials, Products and Services that we describe or make available on the Sites.

Our Site may use “cookies” to enhance User experience and collect Non-Personal Information. A cookie is a small text file which includes an anonymous unique identifier. Cookies are sent to a User’s web browser from our servers, which are then placed on their hard drive for record-keeping purposes and sometimes to track information about them. Sending a cookie to a User’s browser enables Ruido Fest to collect Non-Personal Information about a User and keep a record of the User’s preferences when utilizing our Site and Services, both on an individual and aggregate basis. Ruido Fest may use both persistent and session cookies. Persistent cookies remain on your computer or device after you close your session and until you delete them, while session cookies expire when you close your browser. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Please note that you may not be able to access the full functionality of our Site if cookies are disabled on your browser. We use cookies to see which areas and features of our Site are popular and to count visits to our Site. Our Site also makes use of web browser cookies and tracking pixels for our business purposes, for example to display ads across the Google display network, utilizing social network functionalities (for example, we may use tracking pixels on platforms such as TikTok, Twitter, Facebook, and others to provide a personalized user experience), remarketing, to display ads based on users search history and past browsing history of the Site. Users may opt out of Google’s use of cookies by visiting Google’s Ads Settings.

We may use web beacons (a.k.a. clear GIFs, web bugs or pixel tags) to personalize your experience of the Site and Services and to generate information about traffic and trends. Web beacons collect online information, such as the type of browser that you use and your IP address. Web beacons may be used alone or in conjunction with cookies; when web beacons are used with cookies, they may link online information to other Personal Information that you have provided to us. Web beacons usually are not visible to you.

Some content or applications, including advertisements, on the Site are served by third parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons, or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your Personal Information (for example, if you interact with our Site through a social platform like TikTok, Twitter, or Facebook) or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. Do Not Track

Please note that we currently do not employ technology that recognizes “do-not-track” signals and do not accept them at this time.

How we use collected information

Ruido Company LLC may collect and use Users Personal Information and Non-Personal Information for the following purposes:

  • To improve customer service: Information you provide helps us respond to your customer service requests and support needs more efficiently.
  • To personalize user experiences: We may use information in the aggregate to understand how our Users as a group use the Site and Services.
  • To improve our Site and Services: We may use feedback you provide to improve our website, products and services.
  • To process payments: We may use the payment information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
  • To run a promotion, contest, survey or other Site features.
  • To send Users information they agreed to receive about topics we think will be of interest to them.
  • To send periodic emails: We may use the email address to send you information and updates pertaining to your order, the Site and Services, and to respond to inquiries, questions, and/or other requests Users submit to us. Generally, you may not opt-out of these communications, which are not promotional in nature.  We also may send periodic emails to Users that may include company news, updates, related product or service information, etc. If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email. How we protect your information

We adopt reasonable and appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personal Information.

Sensitive and private data exchange between the Site and its Users happens over an SSL secured communication channel and is encrypted and protected with digital signatures.

However, you understand that, while we follow industry best practices to protect your Personal Information, we cannot guarantee that your information will not be accessed, disclosed, altered or destroyed due to a breach or actions of a third party. By using the Site and Services, you acknowledge that you understand and agree to assume these risks.

Sharing your personal information

We do not sell, trade, or rent Users Personal Information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined in this Privacy Policy. We may decide from time to time to utilize a number of business and marketing partners and other Integrated Sites in delivering the content, materials, Products, and Services. We may share your information with these business and marketing partners for any lawful purpose, including to communicate with you and to further our mission as an organization. To purchase Products, Services, or Subscriptions, we may require credit or debit card account information. By submitting your credit or debit card account information through our Site, you expressly consent to the sharing of your information with Integrated Sites, third-party payment processors, and other third-party service providers. We share this information with our third-party payment service providers in order to process your payments. These third parties may also store your credit or debit card information, other than your CVV number, for your future use on our Site. Your CVV number will not be stored and must be re-entered for each order. Data collected by our third-party payment processors is subject to such third party’s own terms related to data privacy.

Third Party Websites

This Privacy Policy does not apply to any other websites or mobile applications other than each Site, or to information that may be collected by any other websites or mobile applications. Other third parties (such as social media networks, e-commerce platforms, ticketing websites and apps, and payment processing platforms that you may use in connection with our Sites) may also use, collect and share information about you. We are not responsible for, and this Privacy Policy does not apply to, the privacy practices of other companies or other websites or mobile applications. We encourage you to seek out and read the privacy policy of each website that you visit and each mobile application that you use including any which may be integrated with the Sites or App to enable up to provided their functionality and optimal user experience to you. Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. SMS Terms and Conditions

Please read these terms and conditions carefully. We may periodically offer you the opportunity to sign up to receive SMS text messages from us. By clicking the box or advertisement to sign up for one or more text messaging programs, you expressly consent to receive non-marketing and marketing text messages from Ruido Fest and others texting on our behalf, including text messages made with a third -party IP service at the telephone number(s) that you provide.  You may opt-out of these communications at any time, and consent to receive marketing text messages is not required to purchase any Products or Services or use the Site. We may use a third-party IP service to deliver text messages to you which are intended to provide you with information about us, our Services, Products and the Site, upcoming company-sponsored events, shows, promotions, product launches, sweepstakes, and contests and other items which we feel may be of interest to you based on your use of the Site.

Cost

Message and data rates may apply to each text message sent or received from us, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. We do not impose a separate fee for sending or receiving text messages.

How to Opt-In

To opt-in to receive text messages from a Ruido Fest text messaging program, please follow the instructions provided by the specific advertising or offer from which you wish to receive messages. We will clearly describe what you are signing up for and how frequently you can expect text messages related to the campaign you sign up for when you elect to opt-in

How to Opt-Out

To stop receiving text messages from a specific text messaging program, text STOP to the phone number for the text messaging program from which you no longer wish to receive message (i.e., the ten-digit number from which its text messages are being sent).  You will then receive confirmation of your opt-out of that text messaging program.  This will only opt you out of the specific text messaging program associated with that ten-digit number.  You will remain opted in to other Ruido Fest text messaging programs, if applicable.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide. You agree to indemnify Ruido Fest and our affiliates in full for all claims, expenses, and damages related to or caused in whole or in part if you provide us with an inaccurate number or by your failure to notify us if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act and other applicable laws.

Access or Delivery to Mobile Network is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions.  You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Ruido Fest’s control, and we are not responsible or liable for issues arising from them.

Support/Help

To request more information, text HELP to the ten-digit number for the text messaging program about which you have questions (i.e., the ten-digit number from which its text messages are being sent).

Eligibility

To receive text messages from us, you must be a resident of the United States and 18 years of age or older.  We reserve the right to require you to prove that you are at least 18 years of age.

Termination of Text Messaging

We may suspend or terminate your receipt of text messages from us if we believe you are in breach of these SMS Terms and Conditions, of any other aspect of our Privacy Policy or Terms and Conditions.  Your receipt of Ruido Fest text messages is also subject to termination in the event that your mobile telephone service terminates or lapses.  We reserve the right to modify or discontinue, temporarily or permanently, all or any part of a text message campaign with or without notice.

Compliance with Children’s Online Privacy Protection Act

We do not knowingly collect any Personal Information from children under 13 without prior verifiable parental consent. If Ruido Fest learns that a child under the age of 13 has submitted Personal Information to us without parental consent, we will take all reasonable measures to delete the information as soon as possible and to not use such information for any purpose, except where necessary to protect the safety of the child or others as required or allowed by law. Rights of EU Residents

The Site is hosted and operated in the United States. However, Ruido Fest and our Contractors may, in our effort to provide the Site, store collected information in the United States, or we may transfer it to, and store it within, other countries.

Those who access or use the Site from jurisdictions outside the United States do so at their own choice and risk and are solely responsible for compliance with local law. If you are not a resident of the United States, you acknowledge and agree that we may collect and use your Personal Information outside your home jurisdiction, and that we may store your Personal Information in the United States or elsewhere. Consumer Rights

You have the right to request that we delete personal information we collected from you subject to certain exceptions.

You have the right to “opt-out” of your personal information being sold to certain third parties.  This right can be exercised by submitting a Do Not Sell My Personal Information request.

You also have the right to not be discriminated against in pricing and services because you exercise any of your rights under the CCPA. LNRS does not offer financial incentives or price or service differences to consumers in exchange for the retention or sale of a consumer’s personal information.

You may be required to submit proof of your identity for these requests to be processed. Such information may include your First Name, Last Name, Street Address, City, Zip, and Date of Birth and either your Social Security Number or your Driver’s License Number and State.  This information will be used only for the purposes of verifying your identity and processing your request. We may not be able to comply with your request if we are unable to confirm your identity or to connect the information you submit in your request with personal information in our possession. You may designate an authorized agent to make a request on your behalf subject to proof of identity and written authorization.

We will respond to your request consistent with the CCPA, which does not apply to certain information, such as information made available from government records, certain data subject to the Fair Credit Reporting Act (FCRA), Gramm-Leach-Bliley Act (GLBA) and certain other laws, and where its application is preempted by, or in conflict with, federal law or the United States or California Constitution.
